员工不是在“工作场所”受伤是否算工伤

   重庆市江北区劳动和社会保障局根据《工伤保险条例》第十四条第(一)项的规定,认定胡某受伤性质属于因工受伤。誉膳酒楼不服重庆市江北区劳动和社会保障局作出的工伤认定书,向重庆市劳动和社会保障局申请行政复议。重庆市劳动和社会保障局经复议予以维持。誉膳酒楼仍不服,向重庆市江北区人民法院提起行政诉讼,认为:胡某受伤地点在同创国际四楼电梯内,不是在上班地点即誉膳酒楼内,不符合工伤保险条例第十四条第(一)项“职工在工作时间和工作场所内,因工作原因受到事故伤害的,应当认定为工伤”的规定,请求法院判决撤销重庆市江北区劳动和社会保障局作出的工伤认定。
